  • JME recently confirmed the chapter 11 subchapter v case for Marinetek North America, Inc. (“Marinetek”). Marinetek is a Delaware for profit corporation with its headquarters in Pinellas County, Florida. The debtor’s parent company Marinetek Group Oy is a Finnish company. The debtor primarily engineers and builds floating docks that feature long-lasting safety, comfort and reliability. The case was confirmed late 2021 on a consensual basis, meaning the debtor obtained the consent of all impaired classes of creditors. The case presented some unique international issues but ultimately was a great success for the debtor, which can now reorganize and continue operations.
  • JME confirmed the chapter 11 subchapter v case for Nature Coast Emergency Medical Foundation, Inc. (“Nature Coast”). Nature Coast is a Florida not-for-profit corporation that provided emergency medical transportation services in Citrus County, Florida (“Citrus”). Nature Coast filed the bankruptcy on an emergency basis in response to a termination letter it received from Citrus just 15 days earlier. The bankruptcy provided a vehicle for the debtor to orderly wrap up its affairs and eventually hand off the remaining matters to a liquidating trust. Nature Coast’s plan was not objected to and confirmed on a consensual basis, meaning it obtained the consent of all impaired classes of creditors. This bankruptcy demonstrates that subchapter v’s can be a valuable resource for liquidating debtors, and in this case, allowed the debtor to ensure the Citrus’ citizens received uninterrupted life-saving care.
